These Terms of Service ("Terms") govern your access to and use of The Daily Stitch, including our website, online store, digital crochet patterns, downloadable files, and related services (collectively, the "Services").

The Daily Stitch is operated by Tohana Global LLC ("The Daily Stitch," "we," "us," or "our").

By accessing our website, purchasing a digital product, downloading a crochet pattern, or otherwise using our Services, you agree to these Terms and any policies referenced or posted on our website.

1. ELIGIBILITY AND ACCEPTANCE

You must be legally capable of entering into a binding agreement in your jurisdiction to purchase from or use our Services.

If you use the Services on behalf of a business or organization, you represent that you have authority to accept these Terms on its behalf.

2. DIGITAL CROCHET PRODUCTS

The Daily Stitch primarily sells digital crochet patterns and related downloadable content, which may include:

  • PDF crochet patterns;

  • Written crochet instructions;

  • Crochet charts and diagrams;

  • Step-by-step tutorials;

  • Reference images;

  • Printable crochet resources; and

  • Other digital crafting materials.

Unless a product listing specifically states otherwise, all products sold by The Daily Stitch are DIGITAL PRODUCTS ONLY.

Product photographs may show a completed crochet project for demonstration and reference purposes.

You are purchasing the instructions or digital files needed to make the item yourself — not the finished crochet item shown in the photographs.

No finished crochet product, yarn, crochet hook, stuffing, safety eyes, accessories, tools, or other physical materials will be shipped to you.

Please carefully review each product listing, including its description, included files, crochet terminology, language, skill level, materials, sizing information, and file format before completing your purchase.

3. DIGITAL DELIVERY

Digital crochet patterns and other downloadable products are generally delivered electronically after successful payment.

Depending on the checkout and delivery system being used, your files may be:

  • Available through a download link after checkout;

  • Sent to the email address provided during checkout; or

  • Made available through an account or digital-download service.

Most digital files should become available shortly after payment is successfully processed.

Delivery may occasionally be delayed due to payment verification, incorrect email information, spam filtering, technical issues, third-party service interruptions, or other circumstances outside our reasonable control.

We will make reasonable efforts to verify your purchase and restore access to the purchased files.

4. LICENSE TO USE CROCHET PATTERNS

When you purchase a crochet pattern or other digital product from The Daily Stitch, you receive a limited, non-exclusive, non-transferable license to download and use the purchased content.

Unless otherwise stated in the individual product listing, the digital pattern is intended for your personal crochet and crafting use.

Your purchase does not transfer ownership of the pattern, copyright, photographs, illustrations, written instructions, or other intellectual property to you.

All intellectual property rights remain with The Daily Stitch, Tohana Global LLC, or the applicable rights holder.

5. SELLING FINISHED CROCHET ITEMS

Unless a specific product listing states otherwise, you may sell physical finished crochet items that you personally make using our patterns on a small-scale basis.

This permission applies only to the physical finished crochet item.

It does not give you permission to sell, share, reproduce, or redistribute the pattern itself.

When selling finished items:

  • The finished item must be handmade by you or your small handmade business;

  • The pattern itself may not be included with the finished product;

  • You may not claim that you designed or created the original crochet pattern;

  • You may not use our original pattern files, charts, diagrams, or instructions in your product listing;

  • You may not use our original product photographs to sell your finished items without our written permission; and

  • Mass production, factory production, or automated commercial manufacturing based on our patterns is not permitted unless we provide written authorization.

6. PROHIBITED USE OF OUR PATTERNS

Our digital crochet patterns and related content may not be copied, reproduced, redistributed, resold, shared, published, or commercially exploited except as expressly permitted by these Terms.

You may not:

  • Resell or redistribute our PDF crochet patterns;

  • Upload our patterns to another website, marketplace, social media platform, forum, group, or file-sharing service;

  • Share purchased files with friends, customers, groups, classes, memberships, or other third parties;

  • Email, message, or otherwise distribute copies of the pattern to others;

  • Translate and redistribute our patterns without written permission;

  • Modify, rewrite, reformat, or adapt our patterns for redistribution or resale;

  • Include our patterns in digital bundles, pattern collections, subscriptions, memberships, courses, or databases;

  • Convert our patterns into another digital format for redistribution;

  • Reproduce substantial portions of our written instructions, charts, diagrams, photographs, or other content;

  • Claim authorship or ownership of our crochet patterns;

  • Use our photographs, graphics, branding, or product-listing content to market your own products without written permission;

  • Use our digital content to create substantially copied or derivative crochet patterns for resale;

  • Upload or distribute our patterns as free downloads; or

  • Use our digital content as part of a commercial dataset, pattern database, or similar digital-content product without written permission.

Purchasing a pattern does not grant permission to redistribute the digital file in any form.

7. CROCHET RESULTS

Crochet is a handmade process, and individual results naturally vary.

We do not guarantee that your completed crochet project will look exactly like the examples shown in our photographs.

Differences may result from factors including:

  • Yarn brand or fiber;

  • Yarn weight;

  • Crochet hook size;

  • Crochet tension or gauge;

  • Individual crochet technique;

  • Skill and experience;

  • Material substitutions;

  • Pattern modifications; and

  • Interpretation of the instructions.

You are responsible for reviewing the pattern requirements, checking gauge and measurements where applicable, and selecting suitable materials for your project.

8. SAFETY OF FINISHED ITEMS

Some crochet projects may contain components such as safety eyes, buttons, beads, cords, stuffing, wire, removable accessories, or other small parts.

Such items may present choking, strangulation, or other hazards and may not be suitable for babies, young children, or pets.

You are responsible for selecting appropriate materials and determining whether a finished crochet item is suitable for its intended use.

If you sell physical items created using our patterns, you are solely responsible for ensuring that those finished products comply with applicable product-safety, labeling, testing, and consumer-protection requirements.

9. PRICES, PAYMENTS, AND TAXES

Product prices, discounts, promotions, and availability may change from time to time without prior notice.

The applicable purchase price will generally be the price displayed at checkout when your order is submitted, except in cases of obvious pricing or technical errors.

You agree to provide accurate and complete payment and billing information.

Applicable taxes may be calculated and collected where required by law.

We reserve the right, where permitted by law, to correct pricing or product-description errors, reject suspicious or fraudulent transactions, limit purchases, or cancel an order.

If we cancel an order after payment has been successfully collected, we will refund the applicable amount.

10. PROMOTIONS AND DISCOUNT CODES

From time to time, The Daily Stitch may offer discounts, promotional codes, bundles, or special offers.

Promotions may have separate eligibility requirements, expiration dates, product exclusions, or other conditions.

Unless expressly stated otherwise:

  • Discount codes cannot be combined;

  • Discounts cannot be exchanged for cash;

  • Discounts cannot be applied retroactively to previous purchases; and

  • Promotional offers may be modified or discontinued where permitted by law.

11. REFUNDS AND DIGITAL PURCHASES

Because our crochet patterns are digital products that become available for download or access after purchase, purchases are generally final once digital access has been provided.

Refund eligibility, file problems, duplicate payments, incorrect files, and related issues are governed by our Return & Refund Policy.

Nothing in these Terms or our Return & Refund Policy limits any mandatory consumer right that cannot legally be excluded or waived.

12. CUSTOMER ACCOUNTS

If customer-account functionality is available, you are responsible for maintaining the confidentiality of your account credentials.

You are responsible for activity occurring through your account to the extent permitted by applicable law.

Please contact us promptly if you believe your account or purchase information has been accessed without authorization.

13. REVIEWS, PHOTOS, AND CUSTOMER CONTENT

You may have the opportunity to submit reviews, photographs of completed crochet projects, comments, suggestions, feedback, or other content.

By submitting content, you confirm that:

  • You have the right to submit it;

  • It does not infringe another person's intellectual property, privacy, or other rights;

  • It is not fraudulent, unlawful, threatening, defamatory, or intentionally misleading; and

  • Your submission complies with applicable law.

To the extent permitted by law, you grant The Daily Stitch and Tohana Global LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share submitted content for purposes related to operating, improving, and promoting our Services.

This may include displaying customer reviews or project photographs on our website or promotional materials, subject to applicable law and our Privacy Policy.

14. THIRD-PARTY SERVICES

Our online store may use or integrate with third-party services, including Shopify, payment providers, digital-download services, analytics services, advertising platforms, email providers, and other technology providers.

We are not responsible for the independent content, availability, privacy practices, or policies of third-party websites and services.

Your use of certain third-party services may also be governed by their own terms and policies.

15. PROHIBITED CONDUCT

You may not use our website or Services to:

  • Violate applicable law;

  • Infringe intellectual property or other legal rights;

  • Commit or attempt fraud;

  • Distribute viruses, malware, or harmful code;

  • Attempt unauthorized access to our website, accounts, systems, or data;

  • Interfere with website security or functionality;

  • Scrape, crawl, or excessively access the website in a manner that disrupts our Services;

The Daily Stitch website and its content, including our crochet patterns, written instructions, charts, diagrams, photographs, illustrations, graphics, logos, branding, product descriptions, and website materials, are owned by or licensed to Tohana Global LLC and are protected by applicable copyright, trademark, and other intellectual property laws.

Except for the limited permissions expressly provided in these Terms, no intellectual property rights are transferred to you through your purchase or use of our Services.

17. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, our Services and digital products are provided on an "as is" and "as available" basis.

While we aim to provide accurate and usable crochet patterns, we do not guarantee that:

  • Website access will always be uninterrupted;

  • Every digital file will be completely free from errors;

  • Every pattern will be suitable for every customer's skill level;

  • A completed project will exactly match the example photographs; or

  • The same results will be achieved with different yarns, hooks, materials, or crochet techniques.

Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Tohana Global LLC, The Daily Stitch, and their owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services or digital products.

To the maximum extent permitted by applicable law, our total liability for a claim directly relating to a purchased digital product will not exceed the amount you paid for the product giving rise to that claim.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

19. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Tohana Global LLC and The Daily Stitch from third-party claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful use of our Services;

  • Your material violation of these Terms;

  • Your infringement of another person's rights; or

  • Your manufacture, marketing, or sale of physical finished products made using our crochet patterns.

This section does not apply where prohibited by applicable consumer law.

20. GOVERNING LAW

These Terms are governed by the laws of the State of Montana, United States, and applicable federal law, without regard to conflict-of-law principles.

However, nothing in this section is intended to deprive consumers of mandatory protections available under the laws applicable to them that cannot legally be waived by contract.

21. SEVERABILITY AND WAIVER

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

22. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our products, Services, business practices, technology, or applicable legal requirements.

When changes are made, we will update the "Last updated" date at the top of these Terms.

Changes will apply prospectively unless otherwise required or permitted by applicable law.
